Recently, we had a meeting with the leadership of the California Bureau of Household Goods and Services (BHGS), where I shared my concerns about how the Federal Motor Carrier’s Safety Administration (FMCSA) has modified the definition of Hold Hostage to four points. In my opinion, their definition is not reasonable, nor is it protective of consumers or the legitimate moving industry. FMCSA was proud of the statistic that Hostage complaints have dropped from 3051 complaints in 2022 to 1032 complaints in 2023 YTD. My contention is that the drop is a result of the definition modification. My contention is that point #2 alone is not reasonable and does not account for the very common practice that scam operators frequently do not provide a contract.
1.       Must have an estimate.
2.       Must have a contract (b/l).
3.       Must have motor carrier’s refusal to deliver.
4.       Must prove payment tendered or offered to tender payment.

BHGS staff understood and felt that my argument was reasonable. The discussion then turned to their own definition, which I felt could use some refinement. They listened to my suggestions and shared their own thoughts and concerns. In the end, they presented a definition that serves the moving public and permitted mover.
The BHGS Hold Hostage Definition is simple and elegant and something that we can support. It states: Any time after taking possession of a consumer’s goods, the mover demands additional payment outside of the agreed-upon price as a condition of releasing the goods and when that demand for additional payment is not permissible by law.

I was recently asked to speak with the Michigan Movers Association at their fall board and member event. We spoke about regulation and the pending Global Household Goods Contract. We also shared my belief that our industry provides opportunities to develop a business that is diverse and unique to your own strengths and interests. I ended my presentation with my own quote, which I think speaks to the value of being an association member, particularly a member of the California Moving and Storage Association. "The best way to ensure a good and fairly priced move is to use a member of the Association. Our members are vetted for all required licensing and insurance, follow a code of conduct, and care about our industry and customers enough to be part of something bigger than their own business."
